The Bio-Medical Waste Management Rules, 2016, as amended from time to time, provide a comprehensive regulatory framework for the safe handling, treatment, storage, transportation and disposal of bio-medical waste generated by health-care facilities and other specified occupiers. A key requirement under these Rules is obtaining authorisation from the prescribed pollution control authority. The authorisation system ensures that every occupier handling bio-medical waste follows prescribed standards and that waste is managed without causing risks to human health or the environment. Under the BMWM Rules, 2016, every occupier of an institution generating, collecting, receiving, storing, transporting, treating or disposing of bio-medical waste and every operator of a common bio-medical waste treatment and disposal facility is required to obtain authorisation from the prescribed authority. The term “occupier” generally refers to a person having administrative control over the institution or its premises where bio-medical waste is generated. Health-care facilities such as hospitals, nursing homes, clinics, dispensaries, veterinary institutions, pathological laboratories, blood banks, research institutions and similar establishments therefore come within the scope of the authorisation requirements.
