Cooperatives in India are voluntary, democratic and member-driven institutions formed to promote the economic and social interests of their members, particularly small and marginal farmers, rural artisans and weaker sections. For their successful operation, a comprehensive legal framework has evolved over time to regulate registration, management, governance, accountability and autonomy of cooperatives. The cooperative laws in India are designed to ensure democratic functioning, financial discipline, transparency and protection of members’ interests while promoting self-reliance and collective action among farmers and producer groups. The constitutional foundation of cooperative laws was significantly strengthened by the Constitution (Ninety-Seventh Amendment) Act, 2011, which inserted Article 19(1)(c) recognizing the right to form cooperative societies as a fundamental right. It also added Article 43B as a Directive Principle of State Policy, emphasizing the promotion of voluntary formation, autonomous functioning, democratic control and professional management of cooperatives. Part IX-B of the Constitution laid down provisions regarding incorporation, regulation and winding up of cooperative societies, including the conduct of elections, auditing and accountability. Although certain provisions relating to state cooperatives were read down by the Supreme Court in 2021 for lack of ratification by states, the amendment reinforced the importance of democratic and autonomous functioning in the cooperative sector. The primary legislation governing cooperatives at the state level is the respective State Cooperative Societies Act. Since cooperatives are primarily a state subject under the Constitution, each state has enacted its own Cooperative Societies Act. These Acts provide for registration of cooperative societies, eligibility criteria for membership, rights and duties of members, share capital structure, election of managing committees, powers and responsibilities of office bearers, audit requirements, dispute resolution mechanisms and procedures for liquidation. State Acts empower the Registrar of Cooperative Societies to supervise, inspect and regulate cooperatives to ensure compliance with legal provisions.
