Folklore, as a vital repository of cultural knowledge, practices, and identity, plays a crucial role in sustaining the social fabric of communities. However, the preservation of folklore raises complex ethical and legal challenges that require careful consideration. These challenges emerge from the tension between the desire to document, study, and share cultural expressions and the need to respect the rights, values, and intellectual property of the communities from which these traditions originate. Four major problems in the ethical and legal dimensions of folklore preservation can be identified: intellectual property rights, cultural appropriation, consent and representation, and commercialization and exploitation. The first major problem is related to intellectual property rights. Folklore, unlike modern artistic or literary creations, often exists in communal and oral traditions without clear authorship. Songs, stories, dances, and rituals may have been passed down through generations, evolving and changing over time.
