The legal basis for policing in India is primarily derived from the Police Act of 1861, enacted during the British colonial period. This Act created a centralised, hierarchical and militaristic structure of policing intended to secure the colonial state and suppress dissent. While independent India has adopted constitutional democracy, the essential framework of the Police Act continues to shape policing practices. Over time, several states have introduced their own Police Acts, and the Supreme Court’s 2006 directives on police reforms attempted to restructure the system to ensure autonomy, accountability and better service delivery.
