Discuss in detail the Salient Features of Service Tax

Service tax was a significant element in the Indian indirect taxation system prior to the introduction of the Goods and Services Tax (GST) in 2017. Although it is no longer applicable, understanding service tax is important in the context of Business Law as applicable to Cooperatives – I because many cooperative societies had to comply with its provisions. Cooperative societies engaged in providing services such as banking, insurance, transportation, and others were liable for service tax if their turnover exceeded prescribed limits. A thorough understanding of the salient features of service tax helps in comprehending the earlier legal and compliance framework that governed cooperatives.

Service tax was a tax levied by the Central Government on certain services provided by service providers. It was introduced in India under the Finance Act, 1994, and the rate of tax, taxable services, exemptions, and procedures were periodically updated through subsequent Finance Acts. The primary objective was to widen the tax base by taxing the service sector, which formed a significant part of the Indian economy.

One of the key features of service tax was that it was a value-added tax. It was levied on the value of the taxable services rendered by a service provider to a service recipient. However, unlike a traditional VAT on goods, service tax was collected at a uniform rate applicable to all services unless otherwise specified.

Initially, service tax was applicable to only three services — telephone services, stockbroking, and non-life insurance. Over time, the ambit of service tax expanded enormously. By 2012, a comprehensive approach was adopted where all services were taxed except those specifically mentioned in a negative list. The concept of negative list taxation made the regime more inclusive, as every service not mentioned in the negative list became taxable by default.
