The Information Technology Act, 2000, as amended in 2002 and later, was enacted with the objective of providing legal recognition to electronic records and facilitating electronic commerce, while also addressing issues of cybercrimes, data protection, and regulation of digital transactions. As disputes relating to cybercrimes, misuse of digital signatures, hacking, identity theft, and breach of data security began to rise, it was necessary to establish a specialized judicial authority to deal with appeals arising out of the adjudicating officer’s orders. In this context, the Cyber Appellate Tribunal (CyAT) was constituted under the Information Technology Act, 2000, and its composition, functions, and powers are significant for understanding the framework of cyber law enforcement in India. The Cyber Appellate Tribunal was established under Section 48 of the Information Technology Act, 2000. It was designed as a quasi-judicial authority with the purpose of hearing appeals against the orders passed by the adjudicating officers appointed under the Act. Since cyber-related issues required technical as well as legal expertise, the Tribunal was expected to provide specialized adjudication distinct from conventional courts, which often lacked the technical background necessary to resolve cyber disputes effectively. The CyAT occupied an important place within the broader scheme of cyber jurisprudence and dispute resolution under Indian law.
