Folklore preservation involves collecting, documenting, archiving, interpreting, and transmitting traditional knowledge, beliefs, customs, rituals, oral narratives, music, dance, crafts, and other forms of cultural expression from one generation to another. While preservation aims to protect cultural heritage from disappearance, it also raises several ethical and legal concerns. These concerns emerge because folklore belongs not merely to individuals but often to communities, and its preservation involves questions of ownership, consent, representation, commercialization, and cultural rights. Four major problems in the ethical and legal dimensions of folklore preservation are issues of ownership and intellectual property rights, informed consent and community participation, commercialization and cultural exploitation, and authenticity, representation, and cultural sensitivity. One of the most significant problems is the issue of ownership and intellectual property rights. Unlike literary works or inventions, folklore is generally collective in origin and evolves over generations. Traditional songs, folktales, proverbs, designs, rituals, and medicinal knowledge are often regarded as community property rather than the creation of a single identifiable author. Modern copyright laws, however, are primarily designed to protect individual creators for a limited period. This mismatch creates legal uncertainty regarding who owns folklore and who has the authority to grant permission for its use. Researchers, publishers, museums, tourism industries, and commercial enterprises may reproduce or profit from folklore without adequately recognizing or compensating the communities from which the traditions originate.
