Preservation of folklore, while essential to maintaining cultural heritage, presents several ethical and legal challenges. These challenges arise from the complex nature of folklore as a form of intangible cultural heritage, passed orally and communally, without clear ownership or origin in many cases. As efforts to document, archive, and sometimes commercialize folklore increase, questions regarding consent, ownership, benefit-sharing, and cultural sensitivity have emerged. The four major problems in the ethical and legal dimensions of folklore preservation are the issues of intellectual property rights, cultural appropriation, consent and representation, and benefit-sharing. One of the foremost issues is the problem of intellectual property rights (IPR). Traditional folklore does not neatly fit into the framework of existing IPR laws, which are largely designed to protect individual authorship and limited time durations.
