The enactment of the Bureau of Indian Standards Act, 2016 was necessitated by the changing dynamics of the Indian economy, the growing complexity of markets, and the increasing need to ensure quality, safety, and reliability of goods and services in the interest of consumers. Prior to this legislation, the standardization and certification framework in India was governed by an older legal regime that had become inadequate in addressing contemporary challenges such as globalization, technological advancement, and the proliferation of substandard and counterfeit products. The new Act was therefore introduced to strengthen the institutional framework of the Bureau of Indian Standards and to align India’s quality infrastructure with international best practices. One of the primary reasons for the enactment of this Act was the need to enhance consumer protection in an increasingly competitive and diversified marketplace. With the expansion of trade and the entry of numerous domestic and foreign manufacturers, consumers are often exposed to products of varying quality. In such a scenario, the absence of robust standards and enforcement mechanisms can lead to the circulation of unsafe and inferior goods. The Act empowers the Bureau of Indian Standards (BIS) to establish and enforce standards for products, processes, and services, thereby ensuring that consumers receive goods that meet minimum quality and safety requirements. This is particularly important in sectors such as food, electronics, construction materials, and healthcare products, where substandard goods can pose serious risks to life and property. Another significant need for the enactment of the Act was to address the limitations of the previous system of voluntary certification. Under the earlier framework, many standards were not mandatory, which allowed manufacturers to bypass quality norms without facing legal consequences.
